If all players Negotiate consecutively
on their turn, the game ends and the
faction that rules the most areas wins.
The first tiebreaker is the faction
with the most stones on the axe.
The second tiebreaker is the faction
with the most stones on the flag.
If all else fails, no one wins.
So you can't even determine a player winner if there's no faction winner first. -

Which includes this clarification:
2. WINNING FACTION
The Faction that rules the most areas wins.
If tied, the tied faction with the most stone on the axe wins.
If still tied, the still tied faction with the most stone on the flag wins.
If still tied, there is no winning faction and there is no winning player.
This game ended the same way, it shouldn't be that easy to force a win, just end the game on a color tie with less stones?
